Terms of Service

Welcome to the online game Monsters & Memories (tm), operated by Niche Worlds Cult, LLC ("Niche Worlds Cult," "we," "our," or "us"). These Terms of Service ("Terms") govern your use of our game software and related services (collectively, the "Service"). By accessing or using the Service, you agree to be bound by these Terms.

Use of the Service

Subject to your compliance with these Terms, Niche Worlds Cult grants you a limited, non-exclusive, non-transferable, revocable license to access and use the Service solely for your personal, non-commercial use.

1. Accounts and Registration

In order to use certain features of the Service, you may be required to create an account and provide certain information about yourself. You represent and warrant that all information you provide to us is accurate, complete, and up-to-date. You are responsible for maintaining the confidentiality of your account login information and for all activities that occur under your account. You agree to immediately notify Niche Worlds Cult of any unauthorized use of your account or any other breach of security.

2. User Conduct

You agree to use the Service only for lawful purposes and in accordance with these Terms. You agree not to use the Service:

  • In any way that violates any applicable federal, state, local, or international law or regulation
  • To engage in any conduct that restricts or inhibits anyone's use or enjoyment of the Service, or which, as determined by Niche Worlds Cult, may harm Niche Worlds Cult or users of the Service or expose them to liability
  • To impersonate or attempt to impersonate Niche Worlds Cult, a Niche Worlds Cult employee, another user, or any other person or entity
  • To upload, post, or transmit any User Content (as defined below) that is unlawful, harmful, threatening, abusive, harassing, tortious, defamatory, vulgar, obscene, pornographic, libelous, invasive of another's privacy, hateful, or racially, ethnically, or otherwise objectionable
  • To upload, post, or transmit any User Content that infringes any patent, trademark, trade secret, copyright, or other intellectual property or proprietary right of any party
  • To upload, post, or transmit any advertising, promotional materials, "junk mail," "spam," "chain letters," "pyramid schemes," or any other form of solicitation

3. User Content

You acknowledge and agree that Niche Worlds Cult does not allow users to upload any content or materials to the Service beyond character names, guild names, and chat conversations. Any content that you create or upload within the allowed parameters remains your property, but Niche Worlds Cult may use, reproduce, modify, and distribute that content for the purposes of operating and improving the game, and promoting Niche Worlds Cult.

4. Ownership

The Service and its entire contents, features, and functionality (including but not limited to all information, software, text, displays, images, video, and audio, and the design, selection, and arrangement thereof), are owned by Niche Worlds Cult, its licensors, or other providers of such material and are protected by United States and international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.

5. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION ANY WARRANTY OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

6. Limitation of Liability

IN NO EVENT SHALL NICHE WORLDS CULT, ITS AFFILIATES, LICENSORS, SERVICE PROVIDERS, EMPLOYEES, AGENTS, OFFICERS, OR DIRECTORS BE LIABLE FOR DAMAGES OF ANY KIND, UNDER ANY LEGAL THEORY, ARISING OUT OF OR IN CONNECTION WITH YOUR USE, OR INABILITY TO USE, THE SERVICE, INCLUDING ANY DIRECT, INDIRECT, SPECIAL, INCIDENTAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO, PERSONAL INJURY, PAIN AND SUFFERING, EMOTIONAL DISTRESS, LOSS OF REVENUE, LOSS OF PROFITS, LOSS OF BUSINESS OR ANTICIPATED SAVINGS, LOSS OF USE, LOSS OF GOODWILL, LOSS OF DATA, AND WHETHER CAUSED BY TORT (INCLUDING NEGLIGENCE), BREACH OF CONTRACT, OR OTHERWISE, EVEN IF FORESEEABLE.

IN NO EVENT SHALL THE TOTAL LIABILITY OF NICHE WORLDS CULT TO YOU FOR ALL DAMAGES, LOSSES, AND CAUSES OF ACTION ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE EXCEED THE AMOUNT PAID BY YOU, IF ANY, FOR ACCESSING THE SERVICE DURING THE TWELVE (12) MONTHS IMMEDIATELY PRECEDING THE DATE OF THE CLAIM.

SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE LIMITATION OR EXCLUSION MAY NOT APPLY TO YOU.

By clicking "I Accept" and/or installing the software, you acknowledge that you have read these Terms of Service, understand them, and agree to be bound by them. If you DO NOT agree to these Terms of Service, DO NOT click "I Accept" and do not install or use the software.
